01 The agreement

Terms of Service

These Terms of Service ("Terms") govern your access to and use of the HumanSide Simulations platform, including all simulations, games, and related materials made available by HumanSide Simulations ("we," "us," or "our"). By accessing the platform or purchasing an access code, you agree to these Terms.

1. About the Platform

HumanSide Simulations provides evidence-based business simulations and serious games designed for educational use in university courses, executive education programmes, and organisational training contexts. Access to simulations is granted through single-use digital access codes.

2. Access Codes

  • Each access code grants one individual user access to the designated simulation for the duration specified at the time of purchase or allocation.
  • Codes are single-use and non-transferable. Once redeemed, a code cannot be reassigned to another user.
  • You may not resell, redistribute, or share access codes without prior written consent from HumanSide Simulations.
  • Codes issued for free educator pilot programmes are for evaluation purposes only and may not be distributed to students without a commercial or institutional arrangement.

3. Acceptable Use

You agree to use the platform solely for lawful educational and professional development purposes. You must not:

  • Attempt to copy, reverse-engineer, or extract simulation content, scenarios, or underlying game mechanics.
  • Use the platform to harass, deceive, or harm other users.
  • Circumvent any technical measures that control access to the platform.

4. Intellectual Property

All simulation content, scenarios, instructional materials, and platform design are the intellectual property of HumanSide Simulations and Dr. Paul T. Balwant. Nothing in these Terms grants you ownership of any platform content. Teaching resources provided to educators (debrief guides, rubrics, discussion questions) may be used for internal educational purposes but may not be published or distributed commercially.

5. Platform Availability

We aim to keep the platform available and functional, but we do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the platform at any time. Where a disruption is caused by factors within our control, we will make reasonable efforts to notify affected users and provide remedies where appropriate.

6. Limitation of Liability

To the fullest extent permitted by applicable law, HumanSide Simulations and Dr. Paul T. Balwant shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the platform. Our total liability for any claim arising under these Terms shall not exceed the amount you paid for the access code(s) in question.

7. Governing Law

These Terms are governed by the laws of the Republic of Trinidad and Tobago. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Trinidad and Tobago.

8. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms. The date at the top of this page reflects the most recent update.

02 Your data

Privacy Policy

HumanSide Simulations is committed to protecting the privacy of everyone who visits our website or contacts us. This Privacy Policy explains what personal information we collect, how we use it, and your rights in relation to it.

1. Information We Collect

We collect personal information only when you actively provide it to us. This may include:

  • Contact and enquiry data: your name, email address, institutional affiliation, and the details of your enquiry, submitted via the contact form on our Request Demo page.
  • Payment data: if you purchase access codes, payment details are collected and processed directly by our payment processor (Lemon Squeezy). We do not store your card details.
  • Simulation usage data: basic usage information (such as session completion) may be recorded within the simulation platform to support assessment and research activities.

We do not use cookies for tracking or advertising purposes. Our website does not embed third-party analytics or advertising scripts.

2. How We Use Your Information

We use the information you provide to:

  • Respond to your enquiries and set up educator pilot or institutional access.
  • Process access code purchases and deliver them to you.
  • Communicate updates about the platform that are relevant to you.
  • Improve the design and content of our simulations, drawing on aggregated and anonymised usage patterns.

We will never sell, rent, or trade your personal information to third parties for marketing purposes.

3. Third-Party Services

Our website uses the following third-party services, each subject to its own privacy policy:

  • Formspree: processes form submissions from our contact page. See Formspree's Privacy Policy.
  • Lemon Squeezy: processes payments for access codes. See Lemon Squeezy's Privacy Policy.
  • Cloudflare Pages: hosts this website. See Cloudflare's Privacy Policy.
  • Google Fonts: serves typefaces used on this site. Font requests may be logged by Google.

4. Data Retention

We retain contact enquiry data for as long as it is necessary to manage your relationship with us and no longer than three years after last contact, unless required to retain it for legal or contractual reasons.

5. Your Rights

You have the right to request access to the personal information we hold about you, to request its correction or deletion, and to withdraw consent for communications at any time. To exercise any of these rights, please contact us using the details below.

6. Security

We take reasonable steps to protect your personal information from unauthorised access, loss, or misuse. However, no internet transmission is completely secure, and we cannot guarantee the security of information sent to us electronically.

7. Changes to This Policy

We may update this Privacy Policy from time to time. Any changes will be posted on this page with an updated date.

03 Purchases

Refund Policy

HumanSide Simulations sells digital access codes that grant immediate access to online simulations. Because of the nature of digital products, our refund policy is limited as set out below.

1. No Refunds on Redeemed Codes

Once an access code has been redeemed and simulation access granted, we are unable to offer a refund. This applies regardless of how much of the simulation has been completed.

2. Unredeemed Codes

If you have purchased a code but have not yet redeemed it, you may request a refund within 14 days of purchase by contacting us at the address below with your order confirmation. Refunds for unredeemed codes will be issued to the original payment method within 5–10 business days.

3. Technical Failures

If a code fails to function correctly due to a technical error on our end (for example, a code that cannot be redeemed despite following the correct instructions), we will either issue a replacement code or provide a full refund, at your choice. Please contact us with your order details and a description of the issue.

4. Educator Pilot Codes

Free educator pilot codes are provided at no charge. As no payment is made, no refund is applicable.

5. Bulk and Institutional Orders

For bulk code purchases made under an institutional or organisational arrangement, refund terms are as agreed in the relevant written agreement. If no specific terms are stated, this Refund Policy applies.

6. How to Request a Refund

To request a refund, please email us at [email protected] within the applicable window, including your name, order confirmation number, and the reason for your request. We aim to respond within 2 business days.
